LAST WILL AND TESTAMENT OF

R. B. BUCHANAN

Deceased

 

Together with Testimony and Certificate of Property.

IN THE NAME OF GOD, AMEN, I, Robert B. Buchanan of the City of Marysville, Yuba County, State of California, of the age of thirty-three years, and being of sound mind and memory, do make, publish and declare this, my last will and testament in manner following that is to say:

First: --  I give and bequeath to my wife, Minerva Buchanan the Sum of Ten Thousand Dollars, to my Father, Henry Buchanan the Sum of Two Thousand Dollars, and to my niece, Agnes Ellen Wilts, the sum of One Thousand Dollars; which said several legacies or sums of money I direct and order to be paid to the said respective legatees, within one year after my decease.

Second: -- I give and bequeath to my wife Minerva Buchanan all the rest, residue and remainder of my personal estate, good and chattels, of what nature or kind soever, after the payment of all my just debts.

Third: -- I give, devise and bequeath the one third of all my Real Estate of what nature or kind soever to my wife, Manerva Buchanan, in lieu of dower or right of dower in said estate.

Fourth: -- I give, bequeath and devise all of the balance of my real estate of what nature or kind soever to Manerva Buchanan, Executrix and Schuyler C. Tompkins, executor of this my last will and testament hereinafter nominated and appointed, in trust for the payment of the legacies and charges upon the said estate herein after specified, to be held and possessed by them for the purposes aforesaid, for and during the natural life of my father, Henry Buchanan, and from and after his decease, I give, bequeath and devise said estate to my brother, James Buchanan and to my sisters, Elizabeth Sullivan, Margaretta Eastman, Sarah Hendershott and Mary __________ late widow of Alexander Campbell, decd., and my nieces, Agnes Ellen Wilts, to be divided equally between them, share and share alike.  And I do hereby order and direct that during the continuance of the said trust estate, as aforesaid, there shall be annually paid out of the net income and profits thereof, the Sum of Two Thousand Dollars to my father, Henry Buchanan, and if said income be insufficient to make such payments, then said amount or sufficient thereof shall be taken from said estate for said payment.  And I do hereby direct that all my said real estate shall be sold within one year after my decease, either at public or private Sale and the net proceeds thereof to be put at interest as soon as the same can be done reasonably, for the use and benefit of the afore mentioned legatees.

And lastly, -- I do hereby nominate and appoint my wife, Manerva Buchanan, Executrix and my friend, Schuyler C. Tompkins, executor of this my last will and testament, Hereby revoking all former wills by me made.

In witness Whereof, I have hereunto set my hand and seal this fifteenth day of January in the Year of Our Lord One Thousand Eight hundred and fifty five.

The above instrument consisting of one sheet, was a the date thereof, declared to us by Robert B. Buchanan, the testator therein mentioned, to be his Last Will and Testament; and he at the same time acknowledged to us and each of us, that he had signed and sealed the same; and we thereupon at his request, , and in his presence, and in the presence of each other, signed our names, thereto as attesting witnesses.

LAST WILL AND TESTAMENT

 

of Chas. B. Sampson, Dec’d.

 

STATE OF CALIFORNIA, County of Yuba

In the Name of God, Amen

 

KNOW ALL MEN BY THESE PRESENTS, that I, Charles B. Sampson, a native of the Kingdom of Great Britain and a Subject of the same but now a resident of the City of Marysville, County of Yuba, State of California, one of the United States of North America, being now of sound mind and disposing memory, but being conscious of the instability and uncertainty of human affairs, do make, sign, declare and publish this, my last will and testament:  That is to say –

Item First:  It is my will and pleasure that my daughter, Camilla Beverly Scott Sampson, who was born on the Frith of Thames in the Island of New Ulster of the New Zealand Cluster of Islands, and is now about thirteen or fourteen years of age, residing in the City of Marysville aforesaid shall have * * * * all the real, personal and mixed property of whatever kind of which * * * * * at my death may belong to me or to which I may be entitled after all my just and legal debts to which said property may be subject shall have been fully paid and satisfied.

Unquote:  (His aforesaid daughter was willed everything which possibly might accrue – from inheritance from England – quote” in which I may have or, from his brother an interest as heir at law or otherwise” unquote - - William H. Sampson, of the City of Marysville, County of Yuba and State of California.

He mentioned property at East Riding County of Yorkshire, near Beverly in England.  He was son of Rev. George and Anna Sampson.  His mother then lived at Crittenham, Gloucestershire, England, and possibly he might inherit there also.  His sisters named were Sarah Horton, Augusta St. John, and Ellen Davis, of England, and Georgiana Mary Scott, of perhaps Chittenham, Gloucestershire, England.  Possibly he might inherit from of the aforesaid people.

Quote Item Four:  I do hereby constitute and appoint my friend, John R. Deardorff of the City of Marysville, County of Yuba and State of California, Executor………..with full power to carry out my said intentions and I make and appoint the said Deardorff Guardian for the person and property of may said Daughter until she be married or arrives at the age of twenty-one years and if she marry before she shall arrive at that age then I appoint and do now ordain that said John R. Deardorff shall be Guardian or Trustee…..

Item Fifth:  In case my said Executor John R. Deardorff shall be prevented in any manner either by death or otherwise from executing this, my last will and Testament, I hereby declare that it is my will and pleasure that his wife, Mary E. Deardorff should do the same, and in such event I hereby appoint her Executrix and Guardian with all the powers herein before conferred upon the said John R. Deardorff ---- And if neither of them shall be able from any cause to carry out the provisions of this, my last will and Testament then I desire that such person as may administer upon or have charge of then my estate may do the same…..

I do hereby set my hand and seal declaring this to be my last will and testament (using a scrawl for seal) this 26 June A.D. 1857.

He died in San Francisco, California, on the 8th of Oct. A.D. 1861.
